Release of Liability

ROCKY MOUNTAIN MEDITATION GROUP RELEASE AND WAIVER OF LIABILITY, HOLD HARMLESS AND INDEMNIFICATION AGREEMENT

In consideration of being permitted to participate in any event, class, retreat, meditation session, workshop, or other activity (collectively, the “Activities”) offered by or held at the premises of the Rocky Mountain Meditation Group (the “Group”), the undersigned participant hereby agrees as follows:

  1. Acknowledgment of Risk I understand that participation in the Activities, including but not limited to meditation, breathwork, gentle movement, sound healing, and other wellness practices, may involve physical, mental, and emotional exertion. I am voluntarily participating with full knowledge that there are inherent risks, including (but not limited to) physical injury, emotional distress, property damage, or, in rare cases, serious injury or death.
  2. Assumption of Risk I hereby expressly assume all risks associated with the Activities, whether known or unknown, and whether arising from my own actions, the actions of others, or the condition of the premises.
  3. Release and Waiver I, on behalf of myself, my heirs, personal representatives, estate, and assigns, do hereby forever release, waive, discharge, and covenant not to sue:
    • Rocky Mountain Meditation Group, its officers, directors, members, volunteers, and agents;
    • The owners, lessors, and managers of the property and premises where the Activities take place currently located at 3333 & 3332 Little Valley Rd, Estes Park, CO 80517 or simply “the premises used by the Group”;
    • Any guest teachers, facilitators, presenters, or independent contractors leading an Activity collectively, the “Released Parties”,
    from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury (including death), or emotional distress that may be sustained by me or to any property belonging to me, whether caused or alleged to be caused in whole or in part by the negligence of the Released Parties or otherwise, while participating in the Activities or while on or about the premises.
  4. Indemnification and Hold Harmless I further agree to indemnify, defend, and hold harmless the Released Parties from any claim, loss, liability, damage, or cost (including reasonable attorney fees) that they may incur due to my participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.
  5. Medical Acknowledgment I confirm that I am in good health and suffer from no physical or mental condition that would prevent safe participation. In the event of a medical emergency, I authorize the Released Parties to secure emergency medical care or transportation as they deem necessary.
  6. Severability / Governing Law If any portion of this Agreement is held invalid, the remainder shall continue in full force and effect. This Agreement shall be governed by the laws of the State of Colorado.

BY CHECKING THE BOX ON THE REGISTRATION FORM I CONFIRM THAT I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A COMPLETE RELEASE OF LIABILITY AND A LEGALLY BINDING CONTRACT BETWEEN MYSELF AND THE RELEASED PARTIES, AND I SIGN IT OF MY OWN FREE WILL.
